Legal Advisor to the Governor  Gaborone

DUTIES / RESPONSIBILITIES

  • Advises & guides the Governor on cost implications associated with legal matters directly affecting the Governor; and provides input into the Office of the Governor’s budget.
  • Monitors expenditure against the approved budget
  • Provides counsel to the Governor on situations such as deadlocks during negotiations with the Bank’s Union to ensure effective relations.
  • Attends External Stakeholder meetings with or on behalf of the Governor and provide counsel as and when required.
  • Advises & guides the Governor on the shareholding partnerships the Bank has with other institutions such as the IMF, MEFMI & BIS
  • Oversees and advises on the appropriate, effective and efficient organisational setup of the legal services function of the Bank.
  • Provides legal representation to the Governor and attends court proceedings for legal matters directly affecting the Governor’s office.
  • Consults with and advises the Governor on Board matters to ensure effective decision making.
  • Provides advice to the Governor on procurement matters to ensure effective implementation of the process, e.g., big tenders that have the potential of bringing the bank to disrepute.
  • Advises and guides the Governor on potential legal risks associated with regulation of commercial banks, e.g. licensing.
  • Minimises legal risks by advising the Governor on any major legal and regulatory issues the Bank encounters, such as litigation risks.
  • Verifies legal documents such as contracts, leases, petitions, MOU’s, appeals, memoranda of law, and other legal related notices received in the Governor’s office and advises accordingly.
  • Negotiates and provides advice on agreements and contracts directly affecting the Governor’s office
  • Prepares reports for the Governor as and when required.
  • Reviews & and ensures that the Bank’s operations and activities are consistent with the relevant constitutive documents and legal instruments including the Bank of Botswana Act, the Banking Act, Byelaws of the Bank and other national legislation like the FIA Act, NBFIRA Act, Virtual Assets Act, and as appropriate, with norms and principles of central banking.
  • Keeps the Governor abreast of all compliance issues and recommends a course of action to remedy such matters.
  • Addresses and ensures that all the audit non-conformities emanating from the Governor’s Office are fully and promptly addressed.
  • Maintains all legal instruments & records within the Governor’s office for referral during a time of need.
  • Identifies diversions and recommends improvements on the Banks’ policies and regulations to align with applicable laws.
  • Provide advice to the Governor, as and when sought, on international legal obligations of the Bank of Botswana and its compliance to international organisations like the International Monetary Fund, Bank for International Settlements and SADC.
  • Mentors and Coaches other legal team members, guides and supports them to ensure seamless implementation of the Bank’s mandate.
  • Manages own personal development plan.
  • Provides advise to other legal team members on their Personal Development Plans.Β

QUALIFICATIONS & EXPERIENCE

  • A Master’s degree in Law (LLM) plus at least eight years post qualification experience as a practicing attorney.Β 
  • Out of the eight years, at least five (5) years should have been experience in providing legal advice in a Corporate, Financial or Banking Sector.
  • Membership in good standing of the Law Society of Botswana is required.

OR

  • A Bachelor’s degree in Law (LLB) plus at least ten years post qualification experience as a practicing attorney.Β 
  • Out of the ten (10) years, at least five (5) years should have been experience in providing legal advice to the roles in a Corporate, Financial or Banking Sector.
  • Membership in good standing of the Law Society of Botswana is required.
